Welcome to SÁHLES. These Terms and Conditions ("Terms") govern your access to and use of our website www.sahles.com ("Website") and all services provided by SÁHLES ("we," "our," or "us"). By using our Website or purchasing our products, you agree to comply with these Terms.

1. Acceptance of terms

By accessing or using this Website, you agree to be bound by these Terms and any applicable laws or regulations. If you do not agree with these Terms, you should not use the Website or make any purchases from us.

2. Definitions and interpretation

  • Design Specifications: Refers to the detailed specifications for the manufacture or remodelling of jewellery. This may include an image of the design, as well as details of the stones, metals, and other materials to be used.

  • GST: Has the meaning defined in the Goods and Services Tax Act 1985 and includes any interest, penalties, fines, or expenses related to GST.

  • Jewellery: Refers to any jewellery (including engagement rings) or other goods or services provided by us, such as ancillary services or design and manufacturing services, as agreed upon in these Terms, the Design Specifications, and/or any Quote.

  • Price: The amount you are required to pay for the jewellery, as stated in any Quote.

  • Terms: These Terms and Conditions, including any additional terms outlined in any Quote.

  • Quote: The written quotation provided by us that details the jewellery and the Price for the goods or services.

  • “Us”, “We”, “Our”: Refers to SÁHLES and, where the context allows, includes our employees, agents, and contractors.

  • “You”, “Your”: Refers to you, our customer, who enters into the agreement with us.

  • Currency: All prices are in New Zealand Dollars (NZD).

  • Plural and Singular: The singular includes the plural and vice versa, as the context requires.

  • Include: The term "include" shall not be interpreted as limiting the scope of the text it refers to.

3. Use of the Website

You agree to use the Website for lawful purposes only and in accordance with these Terms. You may not use the Website to:

  • Engage in fraudulent activity.

  • Violate any intellectual property rights.

  • Upload or transmit viruses or harmful software.

  • Interfere with the operation of the Website or disrupt any network or server.

You are responsible for maintaining the confidentiality of your account information, including your password, and for restricting access to your account.

4. Products

We offer a range of fine jewellery, including but not limited to gold, diamonds, and precious stones. Product descriptions and prices are subject to change without notice. We make every effort to ensure the accuracy of the information displayed on our Website, but we do not guarantee that all descriptions, images, or prices are always accurate.

5. Ordering and payment

When you place an order, you agree to provide accurate and complete information, including billing details. All payments must be made in full at the time of purchase. We accept payments via bank transfer and credit card currently.

We reserve the right to cancel or refuse any order at our discretion, especially in cases of suspected fraud, pricing errors, or inventory issues.

6. Shipping and delivery

At SÁHLES, we believe in creating high-quality, sustainable jewellery with attention to detail. As part of our commitment to encouraging intentional spending rather than over consumption as well as quality over quantity, some of our jewellery pieces are handcrafted or made to order. This means that certain items may take longer to be shipped than mass-produced pieces. Here’s what you can expect:

Complimentary shipping and returns

We offer complimentary shipping for all orders within New Zealand. However, if you wish to return an item, you are responsible for the cost of return shipping. The item must be returned via a courier service with signature required to ensure it is safely delivered back to us.

Please note that if you fail to follow the specified return shipping method and the item is lost, damaged, or otherwise compromised during transit, we will not be liable for the loss or damage and will not issue a refund or replacement. Returned items remain your responsibility until they are received by us. If items are lost or damaged in transit, it is your responsibility to lodge a claim with the courier.

We recommend keeping proof of postage and tracking information for your records when returning an item.

Made to order items:

  • Jewellery pieces that are made to order or custom-designed can take up to 4 weeks to be created and shipped. This allows us to ensure that each piece meets our high standards of craftsmanship.

Ready to ship items:

  • For items that are ready in stock and do not require customisation, we typically ship within 1 week from the date of your order.

  • We will process and ship these items as quickly as possible, and you will receive a shipping confirmation once your order is on its way.

Shipping times:

  • Once your order is ready to ship (whether it is a made to order item or a ready to ship piece), the estimated delivery time is between 5-7 business days

  • Please note that shipping times may vary depending on your location and potential delays from shipping carriers. We are not responsible for any delays caused by third-party carriers or customs processes.

Tracking your order:

Once your order has shipped, you will receive a tracking number via email so you can monitor the progress of your delivery.

Delays:

While we make every effort to meet our shipping estimates, please understand that delays may occur, especially during busy seasons or due to circumstances beyond our control. If you have any concerns please feel free to contact us.

Changing shipping address:

It is your responsibility to provide an accurate and valid shipping address at the time of placing your order. Please ensure that all details are correct to avoid any issues with delivery.

Once an order has been finalised and payment processed, we are unable to modify the shipping address. We recommend double-checking your shipping information before completing the checkout process to ensure successful delivery.

7. Refunds and returns

We want you to be completely satisfied with your purchase. If you are not happy with your product, we offer refunds and returns under the following conditions:

  • Returns must be returned to us within 7 days of you receiving the item.

  • The item must be in its original, unused condition and packaging.

  • Customised or personalised items may not be eligible for return or refund unless deemed defective. 

  • If you believe the item is defective we will send it away to be inspected and if it’s deemed defective you will be eligible for a return, if it is not deemed defective the product will be sent back to you and you will not be eligible for a refund.

  • SÁHLES is in no way liable for general wear and tear, scratches, dents or marks, physical and accidental damage, damage caused to the jewellery by you or another party, loss of precious stones or diamonds, loss or theft of an item.

To request a return or refund, please contact info@sahles.com. We will guide you through the return process. Any refunds will be issued to the original payment method used at the time of purchase.

8. Order cancellation

Once an order is placed and payment has been processed, it is considered final. As our jewellery is often made to order or customised specifically to your requirements, we do not accept cancellations of orders under any circumstances. Please ensure that all details, including sizing and customisation preferences, are correct before completing your purchase. If you have any questions or concerns about your order, we encourage you to contact us immediately before finalising the transaction.

9. Privacy Policy

Your privacy is important to us. By using the Website, you consent to the collection and use of your personal data as described in our Privacy Policy, which can be found on our Website.

We take appropriate measures to protect your personal information and will not share it with third parties unless required by law or necessary to fulfil your order (such as with shipping companies or payment processors).

10. Intellectual property

All content on the Website, including but not limited to text, graphics, logos, images, and software, is the property of SÁHLES or its licensors and is protected by copyright laws. You may not use, copy, or distribute any content without prior written consent.

11. Limitation of liability

To the fullest extent permitted by law, SÁHLES is not liable for any damages, losses, or costs arising from your use of the Website or any products purchased from us. This includes, but is not limited to, indirect, incidental, punitive, or consequential damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless SÁHLES, its directors, employees, affiliates, and agents from any and all claims, damages, losses, or expenses arising out of your use of the Website, violation of these Terms, or infringement of any third-party rights.

13. Consumer Guarantees Act 1993

If you acquire jewellery from us for business purposes, you agree that the Consumer Guarantees Act 1993 (the "Act") does not apply to your purchase. In this case, our liability will be limited to the repair or replacement of the jewellery, as applicable.

If you acquire jewellery from us for personal use as a consumer (as defined under the Act), the Consumer Guarantees Act 1993 will apply, and it will take precedence over any conflicting terms in these Terms and Conditions. We do not provide any guarantees or warranties beyond those set out in the Act, and our liability to you will be limited to our obligations under the Act.

14. One year warranty

At SÁHLES, we are committed to the quality and craftsmanship of our jewellery. To ensure your satisfaction and peace of mind, we offer a one-year warranty on all jewellery purchased through our website. This warranty covers any defects in materials or workmanship under normal wear and tear.

What is covered:

  • Defects in materials (e.g., gold, diamonds, precious stones) or craftsmanship.

  • Loose or damaged settings due to manufacturing errors.

  • Breakage or damage due to defective components.

What is not covered:

  • Damage caused by misuse, accidents, or neglect (e.g., scratched surfaces, broken chains due to pulling or twisting).

  • Alterations, resizing, or repairs done by someone other than SÁHLES.

  • Normal wear and tear, including tarnishing, discoloration, or fading of jewellery due to exposure to chemicals, perfumes, or extreme conditions.

  • Normal wear and tear, including tarnishing, discoloration, or fading of white gold jewellery. Please note it’s recommended to have your white gold jewellery re-plated with rhodium. Depending on how often the piece is worn, it’s typically advised to re-plate every 1-2 years to maintain its brilliant shine.

  • Loss or theft of the item.

  • SÁHLES is in no way liable for general wear and tear, scratches, dents or marks, physical and accidental damage, damage caused to the jewellery by you or another party, loss of precious stones or diamonds, loss or theft of an item.

How to make a warranty claim:

  • If you believe your jewellery is defective and covered by the warranty, please contact info@sahles.com within one year of your purchase.

  • You must provide a receipt of purchase.

  • We may request that you send us images of the defect and provide additional details to assess the situation.

  • Once your claim is validated, we will offer repair, replacement, or a full refund, depending on the nature of the defect and your preference.

Exclusions:

This warranty is only valid for items purchased directly from our website. Items purchased through third-party retailers or resellers are not eligible for warranty coverage.

14. Product images and representations

We take great care to ensure that the images and descriptions of our products on the Website accurately represent the jewellery you are purchasing. However, due to the handcrafted nature of our pieces and the use of natural materials like diamonds and precious stones, there may be slight variations in color, texture, and appearance from what you see on your screen.

Colour and appearance:

  • The actual colour and appearance of the jewellery may vary slightly depending on factors such as lighting, monitor settings, and device resolution. We make every effort to provide high-quality images that reflect the true look of our products, but please be aware that some differences in hue or finish may occur.

  • For example, gold may appear slightly different in tone, and the natural inclusions in diamonds or stones may vary from one item to another.

Handcrafted variations:

  • As many of our jewellery pieces are handmade, each item is unique. You may notice subtle differences in design, texture, or finish that make your piece one-of-a-kind.

  • These small variations should not be seen as defects, but rather as part of the artistry and craftsmanship that goes into each creation.

If you have any specific concerns regarding a product's appearance before making a purchase, please feel free to contact us, and we would be happy to provide additional images or information to help you make an informed decision.

15. Use of information

We collect and store your personal information in order to fulfill and process your jewellery orders, as well as to improve your shopping experience on our Website. By providing us with your personal details, you agree that we may use this information for the following purposes:

  • To complete your order and deliver the jewellery to you.

  • To communicate with you about your order status, updates, and customer service inquiries.

  • For marketing purposes, including but not limited to sending promotional emails, newsletters, and personalised offers.

You acknowledge and consent that we may share your personal information with third-party service providers who assist us with tasks related to your order, such as payment processors, shipping companies, and marketing partners. These third parties are obligated to handle your information securely and in accordance with applicable privacy laws.

We are committed to protecting your privacy and complying with the Privacy Act 2020. Under this act, you have the right to access and request correction of any personal information we hold about you. If you wish to view, update, or correct your information, please contact us at info@sahles.com.

16. Insurance

We highly recommend that you arrange for appropriate insurance coverage for your jewellery upon receiving it.

If your jewellery is damaged after delivery due to mishandling by you or a third party, failure to properly care for your jewellery, or for any reason not directly related to our craftsmanship you will be responsible for the cost of any repair. This applies unless the repair costs are covered by your insurer.

17. Jewellery care and workmanship

We recommend that you follow the jewellery care guidelines provided in our SÁHLES Jewellery Care Guide, which can be found on our website. We are not liable for any damage to your jewellery that occurs as a result of not adhering to these care instructions.

You acknowledge that metals can naturally "relax" over time after stones are set, which may cause some stones, particularly smaller stones or those set closely together, or designs with minimal claws or surrounding metal, to loosen or fall out. You agree that such occurrences do not constitute defects in workmanship.

Rhodium plating for white gold: White gold jewellery is often plated with rhodium to give it a bright, shiny finish and enhance its white appearance. Over time, this rhodium coating may wear off due to regular wear, revealing the natural yellowish tone of the gold beneath. To restore its lustre, it’s recommended to have your white gold jewellery re-plated with rhodium. Depending on how often the piece is worn, it’s typically advised to re-plate every 1-2 years to maintain its brilliant shine.

18. Custom design process

When you purchase custom-designed jewellery through our website, it is your responsibility to provide accurate measurements and sizing information at the time of ordering. Please ensure that the details you submit are correct, as we will proceed with the design and creation of your jewellery based on the information provided.

Once a custom design is confirmed and the order is placed, the process cannot be cancelled, and no refunds will be issued. Custom-made items are specially created to your specifications, and as such, we are unable to offer cancellations or refunds after the order is confirmed.

If the sizing or measurements provided are incorrect and the jewellery does not fit properly, it is your responsibility to cover the costs of any necessary adjustments or resizing. We recommend you carefully check all details before confirming your order to ensure the correct fit.

19. Ownership and risk

Ownership of all jewellery (excluding any items supplied by you) remains with us until full payment has been made in accordance with these Terms.

The risk for all jewellery remains with us until it has been delivered to you. We strongly recommend that you arrange for appropriate insurance coverage before the jewellery is delivered to you.

20. Delivery

We will make every effort to supply your jewellery by the estimated delivery date. However, due to the nature of custom-made fine jewellery, we cannot guarantee delivery by a specific date. If you need the jewellery for a particular occasion, please inform us before purchasing. If at any point we believe we may not meet your requested timeframe, we will notify you as soon as possible.

Once completed, your jewellery may be delivered to an address you specify. All deliveries are made via a signature-required courier service. You are responsible for ensuring the address you provide is accurate and that you or someone else is available to receive the delivery.

Currently, we only offer shipping within New Zealand.

Jewellery will be considered delivered when:

  • It is signed for by any person at the delivery address provided, acknowledging receipt of the jewellery. We are not responsible if the item is accepted by someone at that address, on your behalf, without your authorisation.

21. Governing law

These Terms are governed by and construed in accordance with the laws of Hastings, Hawke’s Bay, New Zealand, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Hastings, Hawke’s Bay, New Zealand.

22. Waiver

Any delay or failure by us to exercise any right or remedy under these Terms shall not be considered a waiver or variation of that right or remedy. We may exercise our rights or remedies at any time, without limitation.

23. Validity

If any part of these Terms is found to be illegal or unenforceable under applicable law, the remaining provisions will continue in full force and effect, and the illegal or unenforceable provision will be deemed amended to the extent necessary to make it valid and enforceable.

24. Changes to Terms

We reserve the right to modify or update these Terms at any time. Changes will be effective immediately unless stated otherwise, and SÁHLES has no obligation to notify you of such changes. Any changes may be posted on this page with an updated "Effective Date." It is your responsibility to review these Terms periodically to stay informed of any changes. Using this Website shall be deemed acceptance of the amended Terms.

By making a payment or authorising us to proceed with the creation or supply of the jewellery, you have accepted these Terms.
